即時の釈放

(2023年8月1日) ラオス当局は、2023年7月28日以来、著名な中国人人権弁護士ルー・シーウェイ氏を逮捕・拘留していると伝えられている。我々は、同氏が中国への強制送還の深刻な危険にさらされており、そこで拷問やその他の虐待を受ける可能性が高いことを深刻に懸念している。 

東南アジア各国の政府は、弱い立場にある人々を中国に強制送還するよう頻繁に圧力をかけられており、そこで人々は恣意的な拘禁、不公平な裁判、拷問、強制失踪、その他の虐待に直面している。 我々は、2009年のカンボジアからのウイグル人の強制送還から、2022年8月に中国の拘留下でベトナムから失踪した中国の民主活動家・東光平氏に至るまで、数多くの事件を記録してきた。 書店員のグイ・ミンハイ氏は2015年にタイで行方不明になったが、パスポートを持たずに中国で再び姿を現した。 これらの人々は事実上、長期間失踪し、家族や同僚は数か月から数年後まで情報を得ることができない。

我々は第三者政府に対し、以下を要請する

  1. ラオス当局に対して、ルー・シーウェイ氏の本国送還をただちに停止し、国連関連当局や本人が選んだ弁護士に面会できるよう迅速に動くよう要請する。
  2. 中国当局に対して、ルー・シーウェイ氏に対するあらゆる告発を取り下げることを要請する。

ルー・シーウェイを中国当局に引き渡すことにより、ラオス政府はルー・シーウェイを拷問や非人道的な扱いの重大な危険にさらすことになる。 国連の人権専門家らは、中国政府が権利擁護活動家や弁護士を頻繁に拷問や非人道的な扱いにさらしていることを突き止めている。 [1] 　国際慣習法に基づき、また、2012年9月以降は、拷問およびその他の残虐な、非人道的なまたは品位を傷つける取扱いまたは刑罰を禁止する条約 (CAT) の締約国として、ラオス政府には、拷問を受ける可能性の高い国に人を送り返さないという、CAT第3条に規定されたノン・ルフールメント原則に従う義務がある。

我々はラオス政府に対し、以下を要請する

  • ルー・シーウェイ氏の送還プロセスをすべて停止し、国際人権義務に従って直ちに釈放すること。
  • シーウェイ氏が、国連関連当局および本人が選んだ弁護士と面会できるよう手配すること。
  • 現在米国にいる家族と再会するための旅を再開できるよう、必要に応じて米国や他国の外交官との面会を許可すること。
  • 上記を保留し、シーウェイ氏の所在を明らかにし、身の安全と心身の健康を確保すること。

ルー・シーウェイ氏は、中国で著名な権利擁護者兼弁護士であり、弱い立場にあるグループを擁護し、多数の政治的反体制派の代理人を務めている。 中国当局が独立した権利擁護活動に対してますます不寛容になるにつれ、「国家の安全を脅かす」とされるネット上の言論を理由に2021年1月に弁護士資格を剥奪されるなど、シーウェイ氏は脅迫や嫌がらせの標的にされてきた。資格剥奪の審問に向かう途中でも、身体的な攻撃を受けた。 それ以来、シーウェイ氏は中国当局によって厳重に監視されており、2021年5月からは出国禁止の対象となっている。ルー氏は、米国にいる家族と合流する途中でラオスにいたと考えられている。
