The Report also concludes there is also evidence that<br \/>\nPalestinian armed groups committed war crimes.<o:p><\/o:p><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align: left; line-height: 200%;\" align=\"left\"><span style=\"line-height: 200%; font-family: Times; color: black;\" lang=\"EN-US\"><o:p>&nbsp;<\/o:p><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align: left; line-height: 200%;\" align=\"left\"><span style=\"line-height: 200%; font-family: Times; color: black;\" lang=\"EN-US\">The Mission was established pursuant to<br \/>\nthe Human Rights Council Resolution adopted in January 2009, constituted by<br \/>\ndistinguished international lawyers and experts, headed by Justice Richard<br \/>\nGoldstone, a former prosecutor of the ICTY and the ICTR.<o:p><\/o:p><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align: left; line-height: 200%;\" align=\"left\"><span style=\"line-height: 200%; font-family: Times; color: black;\" lang=\"EN-US\"><o:p>&nbsp;<\/o:p><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align: left; line-height: 200%;\" align=\"left\"><span style=\"line-height: 200%; font-family: Times; color: black;\" lang=\"EN-US\">In the Report, the Mission recommended<br \/>\nthat the UN Security Council require Israel to report to it, within six months,<br \/>\non investigations and prosecutions which Israel should carry out with regard to<br \/>\nthe violations identified in the Report. The Mission further recommends that<br \/>\nthe Security Council set up a body of independent experts to report to it on<br \/>\nthe progress of the Israeli investigations and prosecutions. If the expert<br \/>\nbody&#8217;s reports indicate within six months that no good faith, independent<br \/>\nproceedings have been taking place, the Council should refer the situation in<br \/>\nGaza to the ICC Prosecutor.&nbsp;<o:p><\/o:p><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align: left; line-height: 200%;\" align=\"left\"><span style=\"line-height: 200%; font-family: Times; color: black;\" lang=\"EN-US\"><o:p>&nbsp;<\/o:p><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align: left; line-height: 200%;\" align=\"left\"><span style=\"line-height: 200%; font-family: Times; color: black;\" lang=\"EN-US\">The Mission also recommended that the<br \/>\nHuman Rights Council endorse the all recommendations contained in the Report,<br \/>\ntake appropriate action to implement them and continue to review their<br \/>\nimplementation in future sessions.<o:p><\/o:p><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align: left; line-height: 200%;\" align=\"left\"><span style=\"line-height: 200%; font-family: Times; color: black;\" lang=\"EN-US\">The Mission further recommended that<br \/>\nthe Human Rights Council request the UN Secretary-General to bring the Report<br \/>\nto the attention of the United Nations Security Council, as well as submit the<br \/>\nReport to the General Assembly and the Prosecutor of the International Criminal<br \/>\nCourt.<o:p><\/o:p><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align: left; line-height: 200%;\" align=\"left\"><span style=\"line-height: 200%; font-family: Times; color: black;\" lang=\"EN-US\"><o:p>&nbsp;<\/o:p><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align: left; line-height: 200%;\" align=\"left\"><span style=\"line-height: 200%; font-family: Times; color: black;\" lang=\"EN-US\">The Mission recommended that the<br \/>\nGeneral Assembly request the Security Council to report to it on measures taken<br \/>\nwith regard to ensuring accountability for serious violations of international<br \/>\nhumanitarian law and human rights law related to the military operations in<br \/>\nGaza. The Mission further suggested that the General Assembly may consider<br \/>\nwhether additional action within its powers is required in the interests of<br \/>\njustice, including under resolution 377 (V) Uniting for Peace.<o:p><\/o:p><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align: left; line-height: 200%;\" align=\"left\"><span style=\"line-height: 200%; font-family: Times; color: black;\" lang=\"EN-US\"><o:p>&nbsp;<\/o:p><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align: left; line-height: 200%;\" align=\"left\"><span style=\"line-height: 200%; font-family: Times; color: black;\" lang=\"EN-US\">Human Rights Now(HRN), a Tokyo based international<br \/>\nhuman rights NGO constituted by over 600 lawyers and academics, welcomes this<br \/>\nlong awaited report and firmly endorses all the recommendations in the Report.<br \/>\nHRN requests the UN Security Council, the General Assembly and the Human Rights<br \/>\nCouncil to sincerely implement all recommendations made by the Mission in order<br \/>\nto reestablish justice, accountability and human rights.&nbsp;<o:p><\/o:p><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align: left; line-height: 200%;\" align=\"left\"><span style=\"line-height: 200%; font-family: Times; color: black;\" lang=\"EN-US\">Although reportedly over 1400 people<br \/>\nhave been killed during the conflict, there is no good faith on the internal<br \/>\ninvestigations and prosecutions on the violations of international human rights<br \/>\nand humanitarian law. International community must not allow impunity on the<br \/>\nconflict.<o:p><\/o:p><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align: left; line-height: 200%;\" align=\"left\"><span style=\"line-height: 200%; font-family: Times; color: black;\" lang=\"EN-US\"><o:p>&nbsp;<\/o:p><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align: left; line-height: 200%;\" align=\"left\"><span style=\"line-height: 200%; font-family: Times; color: black;\" lang=\"EN-US\">The Mission conducted two field visits<br \/>\nto Gaza between May and July 2009, detailed analysis of 36 specific incidents<br \/>\nin Gaza, as well as a number of others in the West Bank and Israel. The Mission<br \/>\nheard 38 testimonies during two separate public hearings held in Gaza and<br \/>\nGeneva, conducted 188 individual interviews, reviewed more 10,000 pages of<br \/>\ndocumentation, and viewed some 1,200 photographs, as well as 30 videos.&nbsp;<o:p><\/o:p><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align: left; line-height: 200%;\" align=\"left\"><span style=\"line-height: 200%; font-family: Times; color: black;\" lang=\"EN-US\">The specific incidents concluded as war<br \/>\ncrimes by the Mission include direct attack against a mosque at prayer time,<br \/>\nshooting of civilians while they were trying to leave their homes to walk to a<br \/>\nsafer place, waving white flags, direct and intentional attack on a hospital<br \/>\nand an ambulance depot by using white phosphorous weapons. The findings of the<br \/>\nMission are supported by various testimonies and facts.&nbsp;<o:p><\/o:p><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align: left; line-height: 200%;\" align=\"left\"><span style=\"line-height: 200%; font-family: Times; color: black;\" lang=\"EN-US\">Based upon the findings of the war crimes<br \/>\nand the grave breach of the Fourth Geneva Convention by Israel and Palestinian<br \/>\narmed group by the highly qualified mission, the international society must act<br \/>\nfor justice and accountability by implementing the recommendations made by the<br \/>\nMission.&nbsp;<o:p><\/o:p><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align: left; line-height: 200%;\" align=\"left\"><span style=\"line-height: 200%; font-family: Times; color: black;\" lang=\"EN-US\"><o:p>&nbsp;<\/o:p><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align: left; line-height: 200%;\" align=\"left\"><span style=\"line-height: 200%; font-family: Times; color: black;\" lang=\"EN-US\">The UN Human Rights Council convenes<br \/>\nits special session on Gaza on the 29th of September 2009. HRN requests that<br \/>\nall member states of the Human Rights Council adopt a resolution to endorse the<br \/>\nReport and all recommendations as a first step toward the implementation of the<br \/>\nrecommendations.<o:p><\/o:p><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align: left; line-height: 200%;\" align=\"left\"><span style=\"line-height: 200%; font-family: Times; color: black;\" lang=\"EN-US\">In<br \/>\nparticular, HRN requests that Canada, which opposed the Council resolution in<br \/>\nJanuary 2009, as well as the member states of the European Uinon and Japan,<br \/>\nwhich abstained to the resolution, change their positions and vote for the<br \/>\nresolution endorsing the Mission&#8217;s Report and recommendations.<o:p><\/o:p><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align: left; line-height: 200%;\" align=\"left\"><font class=\"Apple-style-span\" color=\"#000000\" face=\"Times, helvetica, hirakakupro-w3, osaka, 'ms pgothic', sans-serif\"><br \/><\/font><\/p>\n<p class=\"MsoNormal\" style=\"text-align: left; line-height: 200%;\" align=\"left\"><span style=\"line-height: 200%; font-family: Times; color: black;\" lang=\"EN-US\">HRN also requests that the United<br \/>\nStates, a new member of the Human Rights Council, support the resolution. This<br \/>\nwill be a good opportunity for the new administration of the United States to<br \/>\nclearly show the world its change in foreign policies from the Bush<br \/>\nadministration.&nbsp;<o:p><\/o:p><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align: left; line-height: 200%;\" align=\"left\"><span style=\"line-height: 200%; font-family: Times; color: black;\" lang=\"EN-US\">There was criticism that the resolution<br \/>\nin January was &#8220;one sided&#8221; and &#8220;politicized&#8221;, however, it is not a legitimate<br \/>\nallegation any more since the independent and impartial investigation has been<br \/>\ndone on both sides by the Mission.&nbsp;<o:p><\/o:p><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align: left; line-height: 200%;\" align=\"left\"><span style=\"line-height: 200%; font-family: Times; color: black;\" lang=\"EN-US\">Despite repeated requests by the<br \/>\nMission, the State of Israel rejected to cooperate with the Mission, and has<br \/>\nstarted attacking the Report. However, the quality of the Report is widely<br \/>\napproved by experts and international NGOs. HRN calls on all governments not to<br \/>\ndiscredit the credibility of the Report and undermine the work of the<br \/>\nMission.&nbsp;<o:p><\/o:p><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align: left; line-height: 200%;\" align=\"left\"><font class=\"Apple-style-span\" color=\"#000000\" face=\"Times, helvetica, hirakakupro-w3, osaka, 'ms pgothic', sans-serif\"><br \/><\/font><\/p>\n<p class=\"MsoNormal\" style=\"line-height: 200%;\"><span style=\"line-height: 200%; font-family: Times; color: black;\" lang=\"EN-US\">This Report entrusts the UN Security Council and the State of<br \/>\nIsrael to conduct investigations and prosecutions of the violations of<br \/>\ninternational human rights and humanitarian law during the recent conflict in<br \/>\nGaza.
