\n<\/span><\/span><\/span>New UNGA resolution and delay on achieving
\nfull accountability<\/span>
\nadopted a resolution <\/span>requesting
\n<\/i><\/span>the Secretary-General to report <\/span>on the progress of investigations
\nof Israel and the Palestinian side <\/span>to the General Assembly within a period of
\nfive months.
\n1400 people including civilians died during the Gaza Conflict which lasted from
\nbetween December 2008 to January 2009. However, accountability for <\/span>the <\/span>violations of international
\nhumanitarian and international human rights law has still not been <\/span>achieved, <\/span>although more than a year has
\npassed since the conflict.
\nadopted a resolution <\/span>calling for both
\nIsrael and the Palestinian side to undertake investigations that are <\/span>“independent,
\ncredible and in conformity with international standards” within a period of
\nthree months<\/span>, following<\/span>
\nthe release of the report of the U.N. Fact-Finding Mission, (also
\ncalled the Goldstone Mission, which was mandated by the U.N. Human Rights
\nCouncil) which found that both sides of the conflict violated international
\nhumanitarian and human rights law. However, both parties have failed to conduct
\nthe required investigations during the period and a new resolution was adopted
\nto extend the deadline by five months. <\/span><\/span>
\ndelay of the investigations goes against the hope of victims, which may lead to
\nthe acceptance of the situation of impunity<\/span>.<\/span> Therefore, HRN requests the U.N. General Assembly to take further
\naction immediately, rather than waiting five months fo<\/span><\/span>r the results<\/span> <\/span>of the investigations<\/span>.
\ninvestigations
\nIsraeli government, the <\/span>Palestinian Authority
\nand Hamas submitted answers to the Secretary General for the UNGA resolution. <\/span>Neither<\/span> demonstrated
\nthat they had conducted independent and impartial investigations.<\/span><\/span>
\nwas published on January 29, 2010, Israel announced that it had investigated
\n150 cases. However, the entire contents of those investigations have not been
\ndisclosed to the public and transparency in the investigation process has not
\nbeen adequately ensured.
\nconducted in a decidedly one-sided manner, the details of which are as follows:

\ninvestigations in Gaza were conducted,
\nhearings from victims or witnesses were conducted,
\nconfidential briefings which took place <\/span><\/span>inside
\nthe<\/span> military, and
\nat soldiers who were engaged in the military operations, the legality of the
\nmilitary orders and plans themselves or the accountability of superior officers
\nin the chain of command was not examined<\/span>\uff0e<\/span>
\ninvestigations was not independent of the military. Therefore, the credibility
\nand independence of Israel’s investigation are doubtful. The investigation also
\nconcluded that the use of weapons<\/span> containing white phosphorous in a densely populated area is not a
\nviolation of international humanitarian law, <\/span>which deviates
\nconsiderably from the international humanitarian law standards.<\/span> <\/span>
\nHamas, the <\/span>letter<\/span>
\nsubmitted by the <\/span>Palestinian Authority<\/span> on
\nJanuary 29, 2009 to the Secretary General was a notice regarding the
\nestablishment of an independent investigation committee by the Palestinian Authority
\nbut did not detail any substantial content of the investigation. The summary of
\nthe internal investigations submitted by Hamas on February 2, 2010 noted that
\nthe rocket attacks, which the Goldstone report concluded amounted to war
\ncrimes,<\/span> <\/span>did not have
\nthe objective of killing of civilians, but <\/span>only
\nmilitary targets<\/span>. No other <\/span>details were
\ndisclosed.
\nthat the mere extension of the deadline will lead to the implementation of
\ngood-faith investigations in conformity with international humanitarian and
\ninternational human rights law.
\nrequests the U.N. Secretary General to seek the opinions and advice of the U.N.
\nHigh Commissioner of Human Rights and experts of international humanitarian and
\ninternational human rights law on this matter and to monitor and assess the
\nproceedings of investigations independently of Israel and Palestinian in order
\nto make recommendations on the independence, impartiality and transparency of the
\ninvestigations that Israel and Palestine have carried out.<\/span>
\nUNGA resolution by the Government of Japan and other governments, and requests
\nthe international community play further roles.
\nwhich had abstained from voting at the U.N. General Assembly and Human Rights
\nCouncil, voted in favor of the UNGA resolution along with other European
\ncountries including the UK and France<\/span>. HRN considers these votes in favor as
\npositive progress.<\/span>
\nwith regard to the Japanese government, by holding meetings at the Diet and <\/span>making requests<\/span> for the cooperation
\nof Japanese civil society. HRN welcomes the Japanese government’s vote. HRN
\nfurther urges the Japanese government to take more initiatives at the U.N.
\nGeneral Assembly, the Human Rights Council and the Security Council, with
\nregard to the situation in Palestine, so that international humanitarian and
\ninternational human rights law may be respected, and the culture of impunity is
\nended in Gaza.<\/span><\/span>
\nan active role in this matter, should display more active initiatives in this
\nnew phase. This is because three permanent members (the UK, France and China) have
\nvoted in favor of the UNGA, and also because both parties within the conflict
\nhave failed to implement appropriate investigations.
\nreport to the Security Council last September, HRN requests the U.N. Security
\nCouncil to create an opportunity to discuss this matter intensively without
\nwaiting for the due date of the five-month extension and to assess whether the
\ninvestigations would be implemented in a credible and independent manner in
\nconformity with the international humanitarian and international human rights
\nlaw. In the absence of good-faith investigations, HRN requests the U.N.
\nSecurity Council to consider further measures including the referral to the
\nInternational Criminal Court and also requests the Japanese government, a
\nnon-permanent member of the Security Council, to take more initiative in the
\nfuture.
