font-family: 'Times New Roman';\">We would particularly like<br \/>\nto give our deepest thanks to the Burmese women who participated as<br \/>\nwitnesses.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>Thank you for speaking before<br \/>\nthe Tribunal about your painful experiences in spite of the emotional scars that<br \/>\nstill remain.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>Your testimony moved<br \/>\nall of us deeply.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>We are truly grateful<br \/>\nthat you traveled all the way to Japan to participate in this Tribunal.<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin-bottom: 12.0pt;\"><span lang=\"EN-US\" style=\"font-size: 12.0pt; font-family: 'Times New Roman';\">Although the Union of<br \/>\nBurma officially became the Union of Myanmar in June 1989, we shall refer to it<br \/>\nhere as &#8220;Burma&#8221;, in accordance with the name of this Tribunal.<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin-bottom: 12.0pt;\"><span lang=\"EN-US\" style=\"font-size: 12.0pt; font-family: 'Times New Roman';\">According to the statute<br \/>\nof the Tribunal, the International Tribunal on Crimes Against Women of Burma is<br \/>\n&#8220;an ad hoc tribunal for the purpose of discovering the truth regarding serious<br \/>\nhuman rights violations against women occurring in&#8221; the Union of Burma since 1988.<br \/>\n<span style=\"mso-spacerun: yes;\">\u00a0<\/span>The &#8220;crimes against humanity&#8221; for<br \/>\nwhich this Tribunal has jurisdiction are as defined in Article 7 of the Rome<br \/>\nStatute of the International Criminal Court (the &#8220;Rome Statute&#8221;) (Article 2).<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin-bottom: 12.0pt;\"><span lang=\"EN-US\" style=\"font-size: 12.0pt; font-family: 'Times New Roman';\">Thus, the task for this<br \/>\nTribunal is to determine whether or not there are facts that constitute &#8220;crimes<br \/>\nagainst humanity&#8221; committed against women in Burma, and whether the defendant Than<br \/>\nShwe should be held liable for these crimes.<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin-bottom: 12.0pt;\"><span lang=\"EN-US\" style=\"font-size: 12.0pt; font-family: 'Times New Roman';\">In order to make a<br \/>\nfinding of crimes against humanity, it is necessary to find not only that &#8220;murder,&#8221;<br \/>\n&#8220;enslavement,&#8221; &#8220;<\/span><span lang=\"EN-US\" style=\"font-size: 12.0pt; font-family: &lt;br \/&gt;\n'Times New Roman'; mso-fareast-language: EN-US;\">imprisonment or other severe<br \/>\ndeprivation of physical liberty in violation of fundamental rules of<br \/>\ninternational law<\/span><span lang=\"EN-US\" style=\"font-size: 12.0pt; font-family: &lt;br \/&gt;\n'Times New Roman';\">,&#8221; &#8220;torture,&#8221; &#8220;rape and sexual violence&#8221; as set forth in the<br \/>\nindictment were actually perpetrated, but also that the acts were &#8220;directed<br \/>\nagainst a civilian population&#8221; and &#8220;committed as part of a widespread or<br \/>\nsystematic attack.&#8221; <\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin-bottom: 12.0pt;\"><span lang=\"EN-US\" style=\"font-size: 12.0pt; font-family: 'Times New Roman';\">The many reports and<br \/>\ndocuments submitted to the Tribunal as evidence, such as those authored by the <em><span style=\"color: black; font-weight: normal; mso-bidi-font-weight: bold;\">United Nations<br \/>\nSpecial<\/span><\/em><span style=\"color: black;\"> Rapporteur on the Situation of<br \/>\nHuman Rights in Myanmar<em><span style=\"font-weight: normal; mso-bidi-font-weight: &lt;br \/&gt;\nbold;\">, <\/span><\/em><\/span>convincingly demonstrate that the terrible<br \/>\nexperiences of the women who testified in this Tribunal today were not simply isolated<br \/>\nindividual experiences, but were rather shared by numerous Burmese women.<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin-bottom: 12.0pt;\"><span lang=\"EN-US\" style=\"font-size: 12.0pt; font-family: 'Times New Roman';\">This indicates that the<br \/>\nhuman rights violations experienced by women in Burma were likely committed &#8220;as<br \/>\npart of [] widespread or systematic&#8221; acts against ordinary citizens like yourselves,<br \/>\nwho were not combatants.<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin-bottom: 12.0pt;\"><span lang=\"EN-US\" style=\"font-size: 12.0pt; font-family: 'Times New Roman';\">The prosecution asserts<br \/>\nthat liability for such human rights violations should be borne by Than Shwe,<br \/>\nthe Chairman of the State Peace and Development Council, Minister of Defense,<br \/>\nand Commander in Chief of Defense Services.<span style=\"mso-spacerun: &lt;br \/&gt;\nyes;\">\u00a0 <\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin-bottom: 12.0pt;\"><span lang=\"EN-US\" style=\"font-size: 12.0pt; font-family: 'Times New Roman';\">However, the Tribunal<br \/>\nwas not able to find based on the evidence presented, that Than Shwe as a<br \/>\nsuperior officer committed crimes against humanity.<span style=\"mso-spacerun: &lt;br \/&gt;\nyes;\">\u00a0 <\/span>Even though gross human rights violations are likely being committed<br \/>\nin Burma, even though the defendant indisputably holds the highest position in<br \/>\nthe current military junta, and even though there is ample reason to suspect<br \/>\nthat the military junta has taken no measures to address or punish the<br \/>\nperpetrators of these human rights violations, the evidence must clearly prove<br \/>\nthe defendant&#8217;s involvement in these in order to say that the defendant is guilty<br \/>\nof crimes against humanity under Article 7 of the Rome Statute.<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin-bottom: 12.0pt;\"><span lang=\"EN-US\" style=\"font-size: 12.0pt; font-family: 'Times New Roman';\">Even so, it can be easily<br \/>\ndeduced from the evidence presented to the Tribunal that human rights<br \/>\nviolations of a &#8220;widespread or systematic&#8221; nature continue to occur against<br \/>\nwomen under the Burmese junta led by Than Shwe.<span style=\"mso-spacerun: &lt;br \/&gt;\nyes;\">\u00a0 <\/span>Consequently, we can conclude that it is highly probable<br \/>\nthat the human rights violations suffered by the women of Burma rise to the<br \/>\nlevel of crimes against humanity.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin-bottom: 12.0pt;\"><span lang=\"EN-US\" style=\"font-size: 12.0pt; font-family: 'Times New Roman';\">In light of the powerful<br \/>\nevidence of human rights violations that most likely constitute crimes against<br \/>\nhumanity, we the Tribunal request that the international community including Japan<br \/>\nand members of the international community including ourselves act as follows<br \/>\nin response to violations of the human rights of the women of Burma:<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin-top: 0mm; margin-right: 0mm; margin-bottom: 12.0pt; &lt;br \/&gt;\nmargin-left: 34.5pt; mso-para-margin-top: 0mm; mso-para-margin-right: 0mm; &lt;br \/&gt;\nmso-para-margin-bottom: 12.0pt; mso-para-margin-left: 1.0gd; text-indent: -24.0pt; &lt;br \/&gt;\nmso-char-indent-count: -2.0;\"><span lang=\"EN-US\" style=\"font-size: 12.0pt; &lt;br \/&gt;\nfont-family: 'Times New Roman';\">1That the<br \/>\ninternational community reaffirm that violence against women is a crime no<br \/>\nmatter where it takes place nor whom it is committed by, and that countries have<br \/>\nthe responsibility of prosecuting crimes occurring therein and are responsible<br \/>\nfor taking appropriate measures including the implementation of just<br \/>\npunishment. <span style=\"mso-spacerun: yes;\">\u00a0<\/span>In particular, that it<br \/>\nmakes clear to those countries that have ratified the Convention on the<br \/>\nElimination of All Forms of Discrimination against Women (CEDAW) that to have<br \/>\nratified is to have stated one&#8217;s intent to eradicate violence against women in<br \/>\naccordance with the rules of the international community.<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin-top: 0mm; margin-right: 0mm; margin-bottom: 12.0pt; &lt;br \/&gt;\nmargin-left: 34.5pt; mso-para-margin-top: 0mm; mso-para-margin-right: 0mm; &lt;br \/&gt;\nmso-para-margin-bottom: 12.0pt; mso-para-margin-left: 1.0gd; text-indent: -24.0pt; &lt;br \/&gt;\nmso-char-indent-count: -2.0;\"><span lang=\"EN-US\" style=\"font-size: 12.0pt; &lt;br \/&gt;\nfont-family: 'Times New Roman';\">2Thus far,<br \/>\nthrough the work of the U.N. <em><span style=\"color: black; font-weight: normal; &lt;br \/&gt;\nmso-bidi-font-weight: bold;\">Special<\/span><\/em><span style=\"color: black;\"><br \/>\nRapporteur<em><span style=\"font-weight: normal; mso-bidi-font-weight: bold;\">, <\/span><\/em><\/span>the<br \/>\ninternational community has shared information showing that human rights<br \/>\nviolations are being committed against women in Burma, that such violations<br \/>\nremain unpunished, and that it is very likely that crimes against humanity are being<br \/>\ncommitted.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>That the international<br \/>\ncommunity continue to gather and share all forms of information relevant to<br \/>\nthese crimes in the future.<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin-top: 0mm; margin-right: 0mm; margin-bottom: 12.0pt; &lt;br \/&gt;\nmargin-left: 34.5pt; mso-para-margin-top: 0mm; mso-para-margin-right: 0mm; &lt;br \/&gt;\nmso-para-margin-bottom: 12.0pt; mso-para-margin-left: 1.0gd; text-indent: -24.0pt; &lt;br \/&gt;\nmso-char-indent-count: -2.0;\"><span lang=\"EN-US\" style=\"font-size: 12.0pt; &lt;br \/&gt;\nfont-family: 'Times New Roman';\">3Given<br \/>\nthat it is highly probable that the human rights violations suffered by Burmese<br \/>\nwomen qualify as crimes against humanity, that the international community affirm<br \/>\nthe necessity of taking measures beyond the mere sharing of information.<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin-top: 0mm; margin-right: 0mm; margin-bottom: 12.0pt; &lt;br \/&gt;\nmargin-left: 34.5pt; mso-para-margin-top: 0mm; mso-para-margin-right: 0mm; &lt;br \/&gt;\nmso-para-margin-bottom: 12.0pt; mso-para-margin-left: 1.0gd; text-indent: -24.0pt; &lt;br \/&gt;\nmso-char-indent-count: -2.0;\"><span lang=\"EN-US\" style=\"font-size: 12.0pt; &lt;br \/&gt;\nfont-family: 'Times New Roman';\">4Despite<br \/>\nthe numerous reports, resolutions, and recommendations issued by the<br \/>\ninternational community over the years, we have seen no indication that Burma,<br \/>\nas a member of the international community, has responded to the international<br \/>\ncommunity&#8217;s pleas and taken measures to stop violence against women or properly<br \/>\npunish the perpetrators.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>Thus,<br \/>\ngiven the likelihood that human rights violations still continue in Burma, that<br \/>\nthe international community recognize that the situation has gone far beyond<br \/>\nthe stage where simply depending on the Burmese government to take its own independent<br \/>\nmeasures to address these violations can be justified.<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin-top: 0mm; margin-right: 0mm; margin-bottom: 12.0pt; &lt;br \/&gt;\nmargin-left: 34.5pt; mso-para-margin-top: 0mm; mso-para-margin-right: 0mm; &lt;br \/&gt;\nmso-para-margin-bottom: 12.0pt; mso-para-margin-left: 1.0gd; text-indent: -24.0pt; &lt;br \/&gt;\nmso-char-indent-count: -2.0;\"><span lang=\"EN-US\" style=\"font-size: 12.0pt; &lt;br \/&gt;\nfont-family: 'Times New Roman';\">5Because<br \/>\nit is strongly suspected that the human rights violations against the women of<br \/>\nBurma described to this Tribunal constitute crimes against humanity, that the<br \/>\ninternational community affirm that the situation demands the formation and<br \/>\ndeployment of an independent international investigative body under the<br \/>\nauthority of the U.N. Secretary-General or the U.N. Human Rights Council.<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin-top: 0mm; margin-right: 0mm; margin-bottom: 12.0pt; &lt;br \/&gt;\nmargin-left: 34.5pt; mso-para-margin-top: 0mm; mso-para-margin-right: 0mm; &lt;br \/&gt;\nmso-para-margin-bottom: 12.0pt; mso-para-margin-left: 1.0gd; text-indent: -24.0pt; &lt;br \/&gt;\nmso-char-indent-count: -2.0;\"><span lang=\"EN-US\" style=\"font-size: 12.0pt; &lt;br \/&gt;\nfont-family: 'Times New Roman';\">6If the<br \/>\nactivities of this independent international investigative body fail to improve<br \/>\nthe situation, that the international community demand, as a next step, that<br \/>\nthe U.N. Security Council consider passing a resolution referring the situation<br \/>\nto the prosecutor of the International Criminal Court.<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin-top: 0mm; margin-right: 0mm; margin-bottom: 12.0pt; &lt;br \/&gt;\nmargin-left: 34.5pt; mso-para-margin-top: 0mm; mso-para-margin-right: 0mm; &lt;br \/&gt;\nmso-para-margin-bottom: 12.0pt; mso-para-margin-left: 1.0gd; text-indent: -24.0pt; &lt;br \/&gt;\nmso-char-indent-count: -2.0;\"><span lang=\"EN-US\" style=\"font-size: 12.0pt; &lt;br \/&gt;\nfont-family: 'Times New Roman';\">7Given<br \/>\nthat it is highly likely that human rights violations strongly indicating the<br \/>\nperpetration of crimes against humanity will continue even if the U.N. takes further<br \/>\nproactive actions such as those described in paragraphs 5 and 6 above, that the<br \/>\ninternational community as well as members of the international community such<br \/>\nas ourselves further make efforts to find effective methods for assisting those<br \/>\nwomen who are victimized by, and fighting against, the oppression.<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin-top: 0mm; margin-right: 0mm; margin-bottom: 12.0pt; &lt;br \/&gt;\nmargin-left: 34.5pt; mso-para-margin-top: 0mm; mso-para-margin-right: 0mm; &lt;br \/&gt;\nmso-para-margin-bottom: 12.0pt; mso-para-margin-left: 1.0gd; text-indent: -24.0pt; &lt;br \/&gt;\nmso-char-indent-count: -2.0;\"><span lang=\"EN-US\" style=\"font-size: 12.0pt; &lt;br \/&gt;\nfont-family: 'Times New Roman';\">8Finally, in<br \/>\nlight of the fact that Japan is a part of Asia, that the government of Japan<br \/>\nand the Japanese people affirm that we have a greater obligation than that of Western<br \/>\ncountries to support Burmese people.<span style=\"mso-spacerun: yes;\"><br \/>\n<\/span>That we more effectively gather and share information about the situation<br \/>\nof women in Burma and provide information on human rights violations to the<br \/>\ngovernment and people of Burma in order to further their understanding.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>That we offer as much true humanitarian<br \/>\nsupport as possible to people suffering oppression in Burma as well as those<br \/>\nwho have fled and are living abroad.<span style=\"mso-spacerun: yes;\"><br \/>\n<\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin-top: 0mm;
