The Conference is the first meeting of ICC<br \/>\nstate parties to consider amendments to the Rome Statue since the Statue<br \/>\nentered into force in 2002.<\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify; text-justify: inter-ideograph;\"><span lang=\"EN-US\" style=\"font-size: 10.0pt; font-family: 'Times New Roman'; color: black;\">\u00a0<\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify; text-justify: inter-ideograph;\"><span lang=\"EN-US\" style=\"font-size: 10.0pt; font-family: 'Times New Roman'; color: black;\">Human Rights Now (HRN), an international human<br \/>\nrights NGO based in Tokyo, requests all the governments to take advantage of<br \/>\nthis occasion and work harder on the reinforcement of the ICC and the<br \/>\nrealization of the rule of law in the world.<\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify; text-justify: inter-ideograph;\">\n<p class=\"MsoNormal\" style=\"text-align: justify; text-justify: inter-ideograph;\">\n<p class=\"MsoNormal\" style=\"text-align: justify; text-justify: inter-ideograph;\"><span lang=\"EN-US\" style=\"font-size: 10.0pt; font-family: 'Times New Roman'; color: black;\">1.<br \/>\nJurisdiction over the crime of aggression should be granted to the ICC through<br \/>\nthe amendments to the Rome Statute.<\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify; text-justify: inter-ideograph;\">\n<p class=\"MsoNormal\" style=\"text-align: justify; text-justify: inter-ideograph;\"><span lang=\"EN-US\" style=\"font-size: 10.0pt; font-family: 'Times New Roman'; color: black;\">One of the biggest points of contention at the<br \/>\nConference is the amendment\u00a0of the Rome Statute, regarding the crime of<br \/>\naggression. <\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify; text-justify: inter-ideograph;\"><span lang=\"EN-US\" style=\"font-size: 10.0pt; font-family: 'Times New Roman'; color: black;\">\u00a0<\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify; text-justify: inter-ideograph;\"><span lang=\"EN-US\" style=\"font-size: 10.0pt; font-family: 'Times New Roman'; color: black;\">However, we have seen situations where acts of<br \/>\naggression were committed and innocent civilians were killed since the Statute<br \/>\ntook effect in 2002. It is time to adopt amendments to the Statute and enable<br \/>\nthe ICC to exercise its jurisdiction over the crime of aggression. It is of<br \/>\ndecisive importance in establishing a solid consensus on the crime of<br \/>\naggression as one of the most serious crimes in international law in order to<br \/>\nprevent further aggressions, and implementing a purpose of the Charter of the<br \/>\nUnited Nations which outlaws the use of force in principle.<\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify; text-justify: inter-ideograph;\">\n<p class=\"MsoNormal\" style=\"text-align: justify; text-justify: inter-ideograph;\">\n<p class=\"MsoNormal\" style=\"text-align: justify; text-justify: inter-ideograph;\"><span lang=\"EN-US\" style=\"font-size: 10.0pt; font-family: 'Times New Roman'; color: black;\">2.<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>Conditions for the exercise of<br \/>\njurisdiction over the crime of aggression<\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify; text-justify: inter-ideograph;\">\n<p class=\"MsoNormal\" style=\"text-align: justify; text-justify: inter-ideograph;\"><span lang=\"EN-US\" style=\"font-size: 10.0pt; font-family: 'Times New Roman'; color: black;\">HRN supports the definitions of the crime of<br \/>\naggression proposed by the Special Working Group on the Crime of Aggression.<br \/>\nThis is in accordance with the UN General Assembly resolution 3314 (1974). The<br \/>\nconditions under which the ICC shall exercise jurisdiction with respect to the<br \/>\ncrime are still largely in dispute among the States Parties.<\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify; text-justify: inter-ideograph;\"><s><span lang=\"EN-US\" style=\"font-size: 10.0pt; font-family: 'Times New Roman'; color: black;\"><span style=\"text-decoration: none;\">\u00a0<\/span><\/span><\/s><\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify; text-justify: inter-ideograph;\"><span lang=\"EN-US\" style=\"font-size: 10.0pt; font-family: 'Times New Roman'; color: black;\">The points of contention raised regarding the<br \/>\nconditions for the exercise of the jurisdiction over the crime of aggression<br \/>\nare whether the ICC Prosecutor can initiate an investigation when the Security<br \/>\nCouncil has not made a determination that an act of aggression, as well as what<br \/>\nthe conditions to begin its investigation are, if the Prosecutor is able to do<br \/>\nso. <\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify; text-justify: inter-ideograph;\">\n<p class=\"MsoNormal\" style=\"text-align: justify; text-justify: inter-ideograph;\"><span lang=\"EN-US\" style=\"font-size: 10.0pt; font-family: 'Times New Roman'; color: black;\">HRN does not support the position that the ICC<br \/>\nProsecutor has no authority to initiate its investigation, when the Security<br \/>\nCouncil has not determined that there has been an act of aggression.<\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify; text-justify: inter-ideograph;\"><span lang=\"EN-US\" style=\"font-size: 10.0pt; font-family: 'Times New Roman'; color: black;\">\u00a0<\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify; text-justify: inter-ideograph;\"><span lang=\"EN-US\" style=\"font-size: 10.0pt; font-family: 'Times New Roman'; color: black;\">The Security Council is the UN body to take<br \/>\nresponsible action for peace and security, and the Council also bears the<br \/>\nprimary responsibility to determine an act of aggression. However, the Council<br \/>\nshould not have exclusive authority on making determinations on crimes of<br \/>\naggression. If we look at the Council&#8217;s history, there have been a number of<br \/>\ncases where the Security Council has failed to take responsibility for the<br \/>\nillegal use of force. Granting exclusive authority to the Council involves the<br \/>\nrisk of the exercise of veto by its permanent members not to determine an<br \/>\nexplicit act of aggression. If the ICC is denied its jurisdiction over such<br \/>\ncases, the independence of the Court will be gravely undermined. <\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify; text-justify: inter-ideograph;\"><span lang=\"EN-US\" style=\"font-size: 10.0pt; font-family: 'Times New Roman'; color: black;\">\u00a0<\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify; text-justify: inter-ideograph;\"><span lang=\"EN-US\" style=\"font-size: 10.0pt; font-family: 'Times New Roman'; color: black;\">Article 13 of the Rome Statue stipulates that<br \/>\nthe exercise of jurisdiction by the ICC may be triggered by the Security<br \/>\nCouncil, a State Party, or the Prosecutor acting <i style=\"mso-bidi-font-style: &lt;br \/&gt;\nnormal;\">proprio motu<\/i> and, in the third case, a decision of the Prosecutor<br \/>\nto conduct an investigation <i style=\"mso-bidi-font-style: normal;\">proprio muto<\/i><br \/>\nmust be approved by the Pre-Trial Division of the ICC.<\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify; text-justify: inter-ideograph;\"><span lang=\"EN-US\" style=\"font-size: 10.0pt; font-family: 'Times New Roman'; color: black;\">\u00a0<\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify; text-justify: inter-ideograph;\"><span lang=\"EN-US\" style=\"font-size: 10.0pt; font-family: 'Times New Roman'; color: black;\">It is appropriate to allow the Prosecutor to<br \/>\nexercise its jurisdiction over the crime of aggression on the same conditions<br \/>\nas<\/span><span lang=\"EN-US\" style=\"font-size: 10.0pt; color: black;\"> other crimes<br \/>\nreferred in the Statute,<\/span><span lang=\"EN-US\" style=\"font-size: 10.0pt; &lt;br \/&gt;\nfont-family: 'Times New Roman'; color: black;\"> since there is no reasonable<br \/>\njustification for setting stricter conditions only on the crime of aggression.<br \/>\nIn the case of the State Party referral, a referral by a victim state should<br \/>\nsuffice to satisfy the conditions to authorize the Court to exercise its<br \/>\njurisdiction.<\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify; text-justify: inter-ideograph;\">\n<p class=\"MsoNormal\" style=\"text-align: justify; text-justify: inter-ideograph;\">\n<p class=\"MsoNormal\" style=\"text-align: justify; text-justify: inter-ideograph;\"><span lang=\"EN-US\" style=\"font-size: 10.0pt; font-family: 'Times New Roman'; color: black;\">3.<br \/>\nHRN requests all State Parties of the ICC to support:<\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify; text-justify: inter-ideograph;\">\n<p><span lang=\"EN-US\" style=\"font-size: 10.0pt; font-family: 'Times New Roman'; &lt;br \/&gt;\nmso-fareast-font-family: Times; mso-bidi-font-family: 'Times New Roman'; &lt;br \/&gt;\ncolor: black; mso-ansi-language: EN-US; mso-fareast-language: JA;\">&#8211;<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>the amendments regarding the crime of<br \/>\naggression; and<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin-top: 0mm; margin-right: 6.0pt; margin-bottom: .0001pt; &lt;br \/&gt;\nmargin-left: 6.0pt; mso-layout-grid-align: none; text-autospace: &lt;br \/&gt;\nnone;\"><span lang=\"EN-US\" style=\"font-size: 10.0pt; font-family: 'Times New Roman'; &lt;br \/&gt;\ncolor: black;\">\u00a0<\/span><\/p>\n<p><span lang=\"EN-US\" style=\"font-size: 10.0pt; font-family: 'Times New Roman'; &lt;br \/&gt;\nmso-fareast-font-family: Times; mso-bidi-font-family: 'Times New Roman'; &lt;br \/&gt;\ncolor: black; mso-ansi-language: EN-US; mso-fareast-language: JA;\">&#8211; the amendments<br \/>\nwhich do not require stricter conditions to exercise jurisdiction of the<br \/>\nICC,<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>including the Security<br \/>\nCouncil resolutions.<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin-top: 0mm;
