On 8 July 2009, Human Rights Now sent a letter to the Prime Minister of India regarding the case of Ms. Sampa Dutta who has
\nreportedly been subjected to police harassment and intimidation after
\nregistering a criminal complaint against a police officer from Entally Police
\nStation in Kolkata, West Bengal.

Dear Prime
\nMinister,<\/span><\/p>\n

 <\/o:p><\/span><\/p>\n

We are
\ncontacting you to express our grave concerns regarding the case of Ms. Sampa
\nDutta, who has reportedly been subjected to police harassment and intimidation
\nafter registering a criminal complaint against a police officer from Entally
\nPolice Station in Kolkata, West Bengal.<\/span><\/p>\n

 <\/o:p><\/span><\/p>\n

In her
\ncomplaint (Case No. 31\/2009, 21 January 2009), Ms. Dutta alleges that she was
\nsexually abused by the police officer, Mr. Dharanidhar Pati, in front of her
\nyoung daughter while traveling on a minibus on 21 January 2009. Several months
\nlater, an unidentified man reportedly visited her home and warned her, once
\nagain in the presence of her daughter, that she would face “dire consequences”
\nunless she withdrew her allegations. She filed a complaint about this incident
\nof intimidation on 3 June 2009 at Phoolbagan Police Station (Case No.
\n2220\/2009), but to date the authorities appear to have taken no action on the
\nmatter. <\/span><\/p>\n

 <\/o:p><\/span><\/p>\n

Further, Ms.
\nDutta states that she has been served by the police on several occasions with
\nnotices to appear at Entally Police Station, in violation of Section 160 of
\nIndia’s Criminal Procedure Code of India (which states that “no male under the
\nage of fifteen years or woman shall be required to attend at any place other
\nthan the place in which such male person or woman resides in respect to a
\npolice inquiry”). <\/span><\/p>\n

 <\/o:p><\/span><\/p>\n

We are deeply
\nconcerned that instead of conscientiously dealing with Ms. Dutta’s complaint
\nagainst Mr. Pati as they are required to do, the police appear to be focusing
\ntheir attention on intimidating Ms. Dutta and pressuring her to retract her
\nallegations. We therefore respectfully urge you to:<\/span><\/p>\n

 <\/o:p><\/span><\/p>\n

1) Take
\nimmediate action to protect the physical and psychological integrity of Ms.
\nSampa Dutta and her daughter;<\/span><\/p>\n

 <\/o:p><\/span><\/p>\n

2) Ensure that
\na prompt, effective, thorough, independent and impartial investigation into Ms.
\nDutta’s allegations is carried out, and those found responsible for violating
\nthe law are subject to the appropriate penal, civil and\/or administrative
\nsanctions; <\/span><\/p>\n

 <\/o:p><\/span><\/p>\n

3) Ensure that
\nMs. Dutta and her daughter receive adequate, effective and prompt reparation,
\nincluding adequate compensation, proper medical care and rehabilitation;<\/span><\/p>\n

4) Take steps
\nto ensure the respect of human rights and the fundamental freedoms throughout
\nthe country in accordance with national laws and international human rights
\nstandards.<\/span><\/p>\n
