Despite severe criticisms<br \/>\nfrom the international community, the SPDC has not remedied this human rights<br \/>\nviolation and, to make matters worse, it has conducted criminal trials against<br \/>\nparticipants and their oppression has continued. <o:p><\/o:p><\/span><\/p>\n<p class=\"MsoNormal\" style=\"line-height:150%;mso-layout-grid-align:none;\ntext-autospace:none\"><font class=\"Apple-style-span\" face=\"'Times New Roman', helvetica, hirakakupro-w3, osaka, 'ms pgothic', sans-serif\" size=\"4\"><span class=\"Apple-style-span\" style=\"font-size: 15px; line-height: 22px;\"><br \/><\/span><\/font><\/p>\n<p class=\"MsoNormal\" style=\"line-height:150%;mso-layout-grid-align:none;\ntext-autospace:none\"><span lang=\"EN-US\" style=\"font-size:11.0pt;line-height:150%;\nfont-family:&quot;Times New Roman&quot;;mso-font-kerning:0pt\">On November 11th 2008, the<br \/>\nSPDC rendered the judgement of 65 years in prison-a de facto lifetime<br \/>\nimprisonment- to 23 prominent democratic activists who led the protest movement<br \/>\nfrom August to September 2007. The judgements were confidentially rendered to<br \/>\nso-called 88 generation democratic activists (students at that time who played<br \/>\na main role in democratic movements in 1988) including Mr. Min Ko Naign, in<br \/>\nInsein Prison for 14 members and in each prison for the other 20 members (among<br \/>\nwhich 65 years in prison was the sentence for 9 members) and the judicial<br \/>\nprocesses were completely closed even to their families. In addition, on the<br \/>\nsame day, the SPDC gave the judgement of 12-and-a-half years in prison to Ms.<br \/>\nSu Su New, a prominent activist in labour-related issues. Also, lawyers who defended<br \/>\nthe democratic activists were detained. Furthermore, according to the<br \/>\ninformation we gained, Mr. Ashin Gambira, who lead the democratic movements as<br \/>\na monk in September 2007, was given a judgement of 12 years in prison and some<br \/>\nother monks were also reportedly punished with sentences of imprisonment.<o:p><\/o:p><\/span><\/p>\n<p class=\"MsoNormal\" style=\"line-height:150%;mso-layout-grid-align:none;\ntext-autospace:none\"><span lang=\"EN-US\" style=\"font-size:11.0pt;line-height:150%;\nfont-family:&quot;Times New Roman&quot;;mso-font-kerning:0pt\"><o:p>&nbsp;<\/o:p><\/span><\/p>\n<p class=\"MsoNormal\" style=\"line-height:150%;mso-layout-grid-align:none;\ntext-autospace:none\"><span lang=\"EN-US\" style=\"font-size:11.0pt;line-height:150%;\nfont-family:&quot;Times New Roman&quot;;mso-font-kerning:0pt\">The subjects this judgment<br \/>\nare those involved in a series of activities following the nation-wide<br \/>\ndemocratic movement, including monks, which was triggered by the SPDC&#8217;s<br \/>\none-sided decision on August 15th 2007 to raise the fixed price of fuel and<br \/>\ndaily necessities. The decision was a matter of life or death for Myanmar<br \/>\ncitizens, whose GDP per person is only 219 dollars (less than one dollar per<br \/>\nday), and the citizen leaders and monks started the protest movement in a<br \/>\npeaceful manner to protect citizens&#8217; lives. This movement ultimately grew into<br \/>\nnation-wide democratic movement, but the whole process was conducted peacefully<br \/>\nfrom start to finish. <o:p><\/o:p><\/span><\/p>\n<p class=\"MsoNormal\" style=\"line-height:150%;mso-layout-grid-align:none;\ntext-autospace:none\"><span lang=\"EN-US\" style=\"font-size:11.0pt;line-height:150%;\nfont-family:&quot;Times New Roman&quot;;mso-font-kerning:0pt\"><o:p>&nbsp;<\/o:p><\/span><\/p>\n<p class=\"MsoNormal\" style=\"line-height:150%;mso-layout-grid-align:none;\ntext-autospace:none\"><span lang=\"EN-US\" style=\"font-size:11.0pt;line-height:150%;\nfont-family:&quot;Times New Roman&quot;;mso-font-kerning:0pt\">However, the SPDC clamped<br \/>\ndown the movement by armed force, and they rendered on many participants a de<br \/>\nfacto lifetime imprisonment of 65 years in prison. This is an outrage and<br \/>\nmanifest challenge against democracy.<o:p><\/o:p><\/span><\/p>\n<p class=\"MsoNormal\" style=\"line-height:150%;mso-layout-grid-align:none;\ntext-autospace:none\"><span lang=\"EN-US\" style=\"font-size:11.0pt;line-height:150%;\nfont-family:&quot;Times New Roman&quot;;mso-font-kerning:0pt\"><o:p>&nbsp;<\/o:p><\/span><\/p>\n<p class=\"MsoNormal\" style=\"line-height:150%;mso-layout-grid-align:none;\ntext-autospace:none\"><span lang=\"EN-US\" style=\"font-size:11.0pt;line-height:150%;\nfont-family:&quot;Times New Roman&quot;;mso-font-kerning:0pt\">There is no doubt that<br \/>\nthese judgements were rendered according to the will of the SPDC and were far from<br \/>\nindependent and fairn. This amounts to a violation of fundamental and universal<br \/>\nhuman rights provided by the Universal Declaration of Human Rights, including<br \/>\nthe freedom of expression (Article 19), freedom of peaceful meeting and<br \/>\nassembly (Article 20), prevention of arbitrary arrest and detention (Article<br \/>\n9), and the right to receive independent, fair and open trial (Article 10). <o:p><\/o:p><\/span><\/p>\n<p class=\"MsoNormal\" style=\"line-height:150%;mso-layout-grid-align:none;\ntext-autospace:none\"><span lang=\"EN-US\" style=\"font-size:11.0pt;line-height:150%;\nfont-family:&quot;Times New Roman&quot;;mso-font-kerning:0pt\">On November 18th of this<br \/>\nyear, five experts-Tomas Ojea Quintana (UN Special Rapporteur on the situation<br \/>\nof Human Rights in Myanmar), Leandro Despouy (Special Rapporteur on the<br \/>\nindependence of the judiciary), Frank La Rue (Special Rapporteur on the Right<br \/>\nto Free Expression), Margaret Sekaggya (Special Rapporteur on the situation of<br \/>\nHuman Rights Defenders), Asma Jahangir (Special Rapporteur on the Freedom of<br \/>\nReligion-who were elected by UN Human Rights Council, strongly criticized the<br \/>\nSPDC&#8217;s unfair trials and arbitrary convictions of &#8220;Prisoners of<br \/>\nConscience&#8221; and urged the government to immediately stop the oppression and<br \/>\narrests of people who peacefully exercised their right to free expression. <o:p><\/o:p><\/span><\/p>\n<p class=\"MsoNormal\" style=\"line-height:150%;mso-layout-grid-align:none;\ntext-autospace:none\"><font class=\"Apple-style-span\" face=\"'Times New Roman', helvetica, hirakakupro-w3, osaka, 'ms pgothic', sans-serif\" size=\"4\"><span class=\"Apple-style-span\" style=\"font-size: 15px; line-height: 22px;\"><br \/><\/span><\/font><\/p>\n<p class=\"MsoNormal\" style=\"line-height:150%;mso-layout-grid-align:none;\ntext-autospace:none\"><span lang=\"EN-US\" style=\"font-size:11.0pt;line-height:150%;\nfont-family:&quot;Times New Roman&quot;;mso-font-kerning:0pt\">Human Rights Now strongly<br \/>\nprotests these SPDC measures and calls on the international community,<br \/>\nincluding Japan, to strongly urge the SPDC to release all political prisoners,<br \/>\nincluding the above-mentioned 34 members, immediately and unconditionally. <o:p><\/o:p><\/span><\/p>\n<p class=\"MsoNormal\" style=\"line-height:150%;mso-layout-grid-align:none;\ntext-autospace:none\"><font class=\"Apple-style-span\" face=\"'Times New Roman', helvetica, hirakakupro-w3, osaka, 'ms pgothic', sans-serif\" size=\"4\"><span class=\"Apple-style-span\" style=\"font-size: 15px; line-height: 22px;\"><br \/><\/span><\/font><\/p>\n<p class=\"MsoNormal\" style=\"line-height:150%;mso-layout-grid-align:none;\ntext-autospace:none\"><span lang=\"EN-US\" style=\"font-size:11.0pt;line-height:150%;\nfont-family:&quot;Times New Roman&quot;;mso-font-kerning:0pt\">On October 2nd 2007, the<br \/>\nUN&#8217;s Human Rights Council adopted a resolution concerning the human rights<br \/>\nsituation in Myanmar which expressed strong regret toward the clampdown by its<br \/>\narmed forces. The resolution also urged the government to stop human rights<br \/>\nviolations as well as to abolish all restrictions on expression, peaceful<br \/>\nmeeting, and assembly in addition to recommending the immediate release of all<br \/>\nprisoners arrested in the armed clampdown in 2007 and other political prisoners<br \/>\nincluding Aung San Suu Kyi. It also recommended the SPDC have sincere talks<br \/>\nwith democratic groups. However; none of these have been implemented. The SPDC<br \/>\nargues that they will pave the way for democracy by holding a general election<br \/>\nin 2010, but the series of above-mentioned actions revealed that this process<br \/>\nis simply part of deceiving the international community and is far from the<br \/>\nbeginning of a road to genuine democracy. HRN urges all Member States of the<br \/>\nHuman Rights Council, including Japan and other neighbouring countries, to make<br \/>\nevery effort to correct these grave human rights violations using the Human<br \/>\nRights Council and every other available opportunity.<o:p><\/o:p><\/span><\/p>\n<p class=\"MsoNormal\" style=\"line-height:150%;mso-layout-grid-align:none;\ntext-autospace:none\"><span lang=\"EN-US\" style=\"font-size:11.0pt;line-height:150%;\nfont-family:&quot;Times New Roman&quot;;mso-font-kerning:0pt\"><o:p>&nbsp;<\/o:p><\/span><\/p>\n<p class=\"MsoNormal\" style=\"line-height:150%;mso-layout-grid-align:none;\ntext-autospace:none\"><span lang=\"EN-US\" style=\"font-size:11.0pt;line-height:150%;\nfont-family:&quot;Times New Roman&quot;;mso-font-kerning:0pt\">(Human rights violations in<br \/>\nthe judicial area of Myanmar)<o:p><\/o:p><\/span><\/p>\n<p class=\"MsoNormal\" style=\"line-height:150%;mso-layout-grid-align:none;\ntext-autospace:none\"><span lang=\"EN-US\" style=\"font-size:11.0pt;line-height:150%;\nfont-family:&quot;Times New Roman&quot;;mso-font-kerning:0pt\"><o:p>&nbsp;<\/o:p><\/span><\/p>\n<p class=\"MsoNormal\" style=\"line-height:150%;mso-layout-grid-align:none;\ntext-autospace:none\"><span lang=\"EN-US\" style=\"font-size:11.0pt;line-height:150%;\nfont-family:&quot;Times New Roman&quot;;mso-font-kerning:0pt\">I The unfair arrest and<br \/>\nsentence of the two senior lawyers (U Aung Them &amp; U Khin Mating Shien) <o:p><\/o:p><\/span><\/p>\n<p class=\"MsoNormal\" style=\"line-height:150%;mso-layout-grid-align:none;\ntext-autospace:none\"><font class=\"Apple-style-span\" face=\"'Times New Roman', helvetica, hirakakupro-w3, osaka, 'ms pgothic', sans-serif\" size=\"4\"><span class=\"Apple-style-span\" style=\"font-size: 15px; line-height: 22px;\"><br \/><\/span><\/font><\/p>\n<p class=\"MsoNormal\" style=\"line-height:150%;mso-layout-grid-align:none;\ntext-autospace:none\"><span lang=\"EN-US\" style=\"font-size:11.0pt;line-height:150%;\nfont-family:&quot;Times New Roman&quot;;mso-font-kerning:0pt\">1) These two lawyers have<br \/>\ntaken many cases of democratic activists, including Monk Garnbira, who led the<br \/>\nmassive democratic movement in September 2007. <o:p><\/o:p><\/span><\/p>\n<p class=\"MsoNormal\" style=\"line-height:150%;mso-layout-grid-align:none;\ntext-autospace:none\"><span lang=\"EN-US\" style=\"font-size:11.0pt;line-height:150%;\nfont-family:&quot;Times New Roman&quot;;mso-font-kerning:0pt\">2) Their clients expressed<br \/>\nno faith in the judicial process and therefore were withdrawing the power of<br \/>\nattorney from the two lawyers. The defendants had already told this to the<br \/>\ncourt (Hlaing Township Court) but the judge (Daw Aye Myaing) had instructed<br \/>\nthem to communicate such in writing through their lawyers.<o:p><\/o:p><\/span><\/p>\n<p class=\"MsoNormal\" style=\"line-height:150%;mso-layout-grid-align:none;\ntext-autospace:none\"><span lang=\"EN-US\" style=\"font-size:11.0pt;line-height:150%;\nfont-family:&quot;Times New Roman&quot;;mso-font-kerning:0pt\"><o:p>&nbsp;<\/o:p><\/span><\/p>\n<p class=\"MsoNormal\" style=\"line-height:150%;mso-layout-grid-align:none;\ntext-autospace:none\"><span lang=\"EN-US\" style=\"font-size:11.0pt;line-height:150%;\nfont-family:&quot;Times New Roman&quot;;mso-font-kerning:0pt\">3) After the judge received<br \/>\nthe letter as she had ordered, she submitted it to the Supreme Court with a<br \/>\ncomplaint against the two advocates under Section 3 of the Contempt of Courts<br \/>\nAct, 1926. This is even though the letter was submitted expressing the views of<br \/>\nthe defendants, and the advocates were withdrawing their authority in<br \/>\naccordance with the clients&#8217; wishes.<o:p><\/o:p><\/span><\/p>\n<p class=\"MsoNormal\" style=\"line-height:150%;mso-layout-grid-align:none;\ntext-autospace:none\"><span lang=\"EN-US\" style=\"font-size:11.0pt;line-height:150%;\nfont-family:&quot;Times New Roman&quot;;mso-font-kerning:0pt\"><o:p>&nbsp;<\/o:p><\/span><\/p>\n<p class=\"MsoNormal\" style=\"line-height:150%;mso-layout-grid-align:none;\ntext-autospace:none\"><span lang=\"EN-US\" style=\"font-size:11.0pt;line-height:150%;\nfont-family:&quot;Times New Roman&quot;;mso-font-kerning:0pt\">4) The two accused lawyers<br \/>\nwere not invited to any trial at the Supreme Court and did not even know that<br \/>\nthey had been accused of an offence until they heard of it by happenchance<br \/>\nthrough colleagues, while attending hearings as usual on Friday morning. The<br \/>\ncourt convicted the two without hearing from them, even though it ordinarily<br \/>\ntakes between a week to ten days to hear such a case, and a fortnight and a<br \/>\nmonth for the court to issue a judgment.<o:p><\/o:p><\/span><\/p>\n<p class=\"MsoNormal\" style=\"line-height:150%;mso-layout-grid-align:none;\ntext-autospace:none\"><span lang=\"EN-US\" style=\"font-size:11.0pt;line-height:150%;\nfont-family:&quot;Times New Roman&quot;;mso-font-kerning:0pt\"><o:p>&nbsp;<\/o:p><\/span><\/p>\n<p class=\"MsoNormal\" style=\"line-height:150%;mso-layout-grid-align:none;\ntext-autospace:none\"><span lang=\"EN-US\" style=\"font-size:11.0pt;line-height:150%;\nfont-family:&quot;Times New Roman&quot;;mso-font-kerning:0pt\">5) Police arrested the two<br \/>\nsenior advocates at their houses last night after they were convicted of<br \/>\ncontempt of court. Their lawyers are not allowed to meet<br \/>\nwith their clients in private to have proper consultation and instruction and<br \/>\nthe judge does not allow them sufficient time to make counter questions against<br \/>\nthe prosecution witnesses. Further, they found that the police and some<br \/>\nplain-cloth persons are taking pictures and recording their voices during the<br \/>\ntrials.
