However, justice and accountability on the grave human rights<br \/>\nviolations during the operation have not been achieved yet.<\/p>\n<p>In November 2009, Justice Goldstone, a head of the UN Fact-Finding<br \/>\nMission on the Gaza Conflict, accepted an exclusive interview with<br \/>\nHuman Rights Now.<\/p>\n<p>Human Rights Now is glad to introduce the whole interview here.\u3000<\/p>\n<p> The UN Fact-Finding Mission on the Gaza Conflict, established by<br \/>\nthe UN Human Rights Council, chaired by Justice Goldstone, investigated<br \/>\nhuman rights violations related to the Gaza Conflict. The Mission found<br \/>\nthat war crimes were committed by both Israel and Palestinian armed<br \/>\ngroups and noted a referral to the International Criminal Court.<\/p>\n<p>Despite approvals of a report of the Mission by the UN General Assembly<br \/>\nand the UN Human Rights Council, the UN Security Council has not dealt<br \/>\nwith it yet.<\/p>\n<p>All copyrights of this interview belong to Human Rights Now. Why did you decide to accept the mandate?)<\/p>\n<p>I hesitated to accept the mandate, because the Council resolution was not even handed.<br \/>\nThat is why I rejected first.<br \/>\nBut, it turned out that the structure of the mission includes both side investigations.<br \/>\nUnder this condition, I accepted the mandate and did my best to conduct fair investigation.<\/p>\n<p>(What makes your report special compare to previous fact finding<br \/>\nmission&#8217;s report? The report has great impact, since you identified the<br \/>\nwar crimes and talk about the ICC)<\/p>\n<p>I think that nothing is special.<br \/>\nI just did proper thing. Other fact finding mission did the same thing,<br \/>\nfor example Darfur mission found war crime, and recommend the referral<br \/>\nto the ICC.<\/p>\n<p>(But in case of Israel and Palestine, things are usually different. I<br \/>\nknow this is the first mission established by the UN Human Rights<br \/>\nCouncil, but anyhow, it is quite new thing that war crime and the<br \/>\nreferral to the ICC is discussed clearly in UN official finding related<br \/>\nto OPT.)<\/p>\n<p>We just want to be fair applying international law.<br \/>\nIf the gravity of the human rights violation is the same level, the finding and recommendation should be the same.<\/p>\n<p>(Why did you make recommendation to the Security Council to refer the case to the ICC)?<\/p>\n<p>Because it was the only way to achieve justice for victims in this case.<br \/>\nIsrael is not the state party to the Rome Statute of the ICC, so you need to obtain a Security Council Resolution.<\/p>\n<p>(You found that killings of civilians during this military action<br \/>\nconstitute war crimes. But Israel argues that casualities of Palestine<br \/>\npeople was collateral and it&#8217;s Hamas&#8217;s responsibility to have Palestine<br \/>\npeople as human shield. How do you respond to argument of Israel?)<\/p>\n<p>Among the cases we investigated, we did not find any case that Hamas<br \/>\nused Palestine people as human shield. But we did not investigate all<br \/>\ncases, so I do not know if there is any such case.<br \/>\nBut, even if the Hamas used Palestine people as human shield, it is not<br \/>\njustified to conduct disproportionate attack on civilians.<\/p>\n<p>(Now, Human Rights Council and General Assembly passed resolutions to<br \/>\nsupport your report. What do you expect the international community to<br \/>\ndo next?)<\/p>\n<p>If the Security Council does not act immediately, international<br \/>\ncommunity should put more and more pressure to make both sides conduct<br \/>\nthe proper investigation.<br \/>\nOf course, I hope the Security Council to do the right thing to achieve justice for victims.<\/p>\n<p>(Regrettably, many western countries abstain or against the General<br \/>\nAssembly and Human Rights Council resolution, by saying it is<br \/>\npolitically unbalanced, how is your reaction?)<\/p>\n<p>Why did Japan abstain?<\/p>\n<p>(I remember, the Japanese government said that the resolutions are highly political, or not well balanced.)<\/p>\n<p>I have not heard clear reason why the western countries and Japan<br \/>\nclaimed that my report is not well balanced. I want to ask the reason<br \/>\nclearly. It was very disappointing.<\/p>\n<p>(How do you think the allegation that seeking justice undermines the peace process of Middle East?)<\/p>\n<p>No, achieving justice does always good for peace.<\/p>\n<p>(It is true especially for the case of Middle East. Human rights<br \/>\nviolation is the basis of the conflict, and people suffer from human<br \/>\nrights violation for such a long time without any justice and<br \/>\naccountability.)<\/p>\n<p>Yes.<\/p>\n<p>(What is your last massage to the international community?)<\/p>\n<p>All crimes and violations wherever it was done should be dealt with in the same way under international law.<\/p>\n<p>(Did your work as the head of the mission finish?)<\/p>\n<p>Yes, I finished my job. Now, it is work of civil society to achieve justice.<br \/>\nGood luck.<br \/>\n<img decoding=\"async\" src=\"http:\/\/www.ngo-hrn.org\/eng\/img\/gis.jpg\" \/><\/p>\n<p><\/p>\n<hr>\n<p>\nGlobal civil society coalition urges UN General Assembly to support Goldstone recommendations on Gaza <\/p>\n<hr>\n<p>The General Assembly will meet on 4 November to consider the report of the<br \/>\nUnited Nations fact-finding mission on the Gaza conflict, which found<br \/>\nevidence that both Israel and the Palestinians committed serious war crimes<br \/>\nduring the hostilities earlier this year.<\/p>\n<p>\u3000Human Rights Now, among 40 NGOs around the world, sent open letter to all<br \/>\nmember states of UN General Assembly to support the recommendation of the<br \/>\nGoldstone report and work to adopt a resolution to ensure justice and<br \/>\naccountability for victims of the Gaza conflict.<\/p>\n<p>\nSee the whole letter;<\/p>\n<p><a href=\"http:\/\/rs6.net\/tn.jsp?et=1102800759807&amp;s=657&amp;e=001HP1zc9P758WYgZrDbWsFLmbi_gXPFEj_zryFOdiMJB_W1oaO9V7g-n6fkIfv2RUnuwaWPPDatakXfhVDm1li6V9DMx_Dah3fBBLOa9IFQo7NRjQNSrvQnCZQmrO2gcV3C3A6VMt6vw8PapBR-u7Tb2SxN_XlznBzD9EjvjKEZ1tw7RyB30R_w1C6T1So2wVKcAP1TF3DpRF2rf54o3Te29ZvJ7UT4KcG\" target=\"_blunk\" rel=\"noopener noreferrer\"><br \/>\nhttp:\/\/rs6.net\/tn.jsp?et=1102800759807&#038;s=657&#038;e=001HP1zc9P758WYgZrDbWsFLmbi_gXPFEj_zryFOdiMJB_W1oaO9V7g-n6fkIfv2RUnuwaWPPDatakXfhVDm1li6V9DMx_Dah3fBBLOa9IFQo7NRjQNSrvQnCZQmrO2gcV3C3A6VMt6vw8PapBR-u7Tb2SxN_XlznBzD9EjvjKEZ1tw7RyB30R_w1C6T1So2wVKcAP1TF3DpRF2rf54o3Te29ZvJ7UT4KcG<br \/>\n<\/a><\/p>\n<p>A global coalition of civil society organizations from every corner of the<br \/>\nworld, ranging from Human Rights Now in Japan to the South African Council<br \/>\nof Churches, have urged members of the United Nations General Assembly<br \/>\n(UNGA) to support the recommendations of the Goldstone Report and work to<br \/>\nadopt a resolution which will ensure accountability for victims of the Gaza<br \/>\nconflict earlier this year.<\/p>\n<p>In the letter from the groups, which include Physicians for Human Rights in<br \/>\nIsrael, the Democracy Coalition Project, the Palestinian Centre for Human<br \/>\nRights in Gaza, Open Society Institute, and the Centro de Estudios Legales y<br \/>\nSociales in Argentina, the NGOs urge the adoption of a resolution by the<br \/>\n64th UNGA which calls upon the Israeli Government and relevant Palestinian<br \/>\nauthorities to launch &#8220;credible, independent investigations of the findings<br \/>\nof the Goldstone Report&#8230;[that] will promote accountability among all<br \/>\nparties to the conflict and put an end to the culture of impunity.&#8221;<\/p>\n<p>During the 12th Session of the Human Rights Council, Justice Richard<br \/>\nGoldstone presented a report of the United Nations Fact Finding Mission on<br \/>\nthe Gaza Conflict that found evidence of serious violations of human rights<br \/>\nand humanitarian law committed by both Israeli forces and Hamas fighters.<br \/>\nGoldstone concluded that State parties should start criminal investigations<br \/>\nwhere there is evidence of grave breaches of the Geneva Conventions of 1949.<br \/>\nThe letter specifically asks the United Nations to ensure an independent<br \/>\ninternational mechanism is established to assess investigations by Israeli<br \/>\nand Palestinian authorities.<\/p>\n<p>The organizations urge the international community to demonstrate its<br \/>\nunequivocal support for human rights and the protection of Israeli and<br \/>\nPalestinian civilians. &#8220;The international community must demonstrate resolve<br \/>\non the issue of accountability on both sides of this conflict and ensure<br \/>\nthat international law is upheld. It is this approach which will strengthen<br \/>\nthe chances of peace and justice for Israelis and Palestinians,&#8221; the letter<br \/>\nstates.<\/p>\n<p>Among the 40 current signatories of the letter are the Public Committee<br \/>\nAgainst Torture in Israel, Human Rights Watch, Asian Legal Resources Centre,<br \/>\nUkrainian Helsinki Human Rights Union, Cairo Institute for Human Rights<br \/>\nStudies, Federation Internationale des Ligues des Droits de l&#8217;Homme,<br \/>\nInternational Center for Transitional Justice, and the International<br \/>\nCommission of Jurists.<\/font><\/p>\n","protected":false},"excerpt":{"rendered":"<p>It has been a year since the military operations in Gaza.
