{"id":18,"date":"2008-10-05T09:52:17","date_gmt":"2008-10-05T00:52:17","guid":{"rendered":"http:\/\/test.hrn.or.jp\/?p=18"},"modified":"2019-05-29T11:05:19","modified_gmt":"2019-05-29T02:05:19","slug":"sudan-bashir-icc","status":"publish","type":"post","link":"https:\/\/hrn.or.jp\/eng\/news\/2008\/10\/05\/sudan-bashir-icc\/","title":{"rendered":"Statement about the Investigation and Prosecution of President Bashir of Sudan by The International Criminal Court"},"content":{"rendered":"<p class=\"MsoNormal\" style=\"margin: 0mm 0mm 0pt; line-height: 200%;\"><span lang=\"EN-US\" style=\"font-size: 12pt; line-height: 200%; font-family: 'Times New Roman';\"><span style=\"font-size: 0.8em; color: #000000;\">5 October 2008<\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0mm 0mm 0pt; line-height: 200%;\">\n<p class=\"MsoNormal\" style=\"margin: 0mm 0mm 0pt; line-height: 200%;\"><span lang=\"EN-US\" style=\"font-size: 12pt; line-height: 200%; font-family: 'Times New Roman';\"><span style=\"color: #000000;\"><span style=\"font-size: 0.8em;\">Human<br \/>\nRights Now (HRN), an international human rights NGO based in Tokyo, has<br \/>\nmade the following statement concerning the current situation in the<br \/>\nRepublic of Sudan on 5 October 2008, in the interests of seeking peace<br \/>\nby way of conquering human rights abuses in the country. <\/span><\/span><\/span><\/p>\n<p>Statement about The Investigation and Prosecution of President Bashir of Sudan by The International Criminal Court<\/p>\n<p>In<br \/>\nmid-July 2008, Luis Moreno-Ocampo, chief prosecutor of the<br \/>\nInternational Criminal Court (ICC), requested the court grant an arrest<br \/>\nwarrant against President Bashir of Sudan relating to five cases of<br \/>\ngenocide, three cases of crimes against humanity, and two cases of war<br \/>\ncrimes.<\/p>\n<p>In response to this request, the ICC judges formally<br \/>\nbegan in mid-September to address the issue of an arrest warrant<br \/>\nagainst President Bashir.<\/p>\n<p>In Darfur region of Sudan,<br \/>\nit is said that a hybrid army consisting of the national army and<br \/>\nmilitia supported by the Sudanese Government raided villages and<br \/>\ncarried out acts of genocide against a large number of innocent people.<br \/>\nAs a result, there are allegedly more than two million refugees from<br \/>\nthe crisis at present..<\/p>\n<p>Considering these humanitarian victims,<br \/>\nthe ICC&#8217;s prosecution against President Bashir is logical and essential<br \/>\nfor the purposes of international justice.<\/p>\n<p>Nevertheless, there is an argument against the ICC&#8217;s prosecution.<\/p>\n<p>Regarding<br \/>\nthe Security Council Resolution, it is unknown whether there will be<br \/>\nserious opposition to the investigation and prosecution of President<br \/>\nBashir.<\/p>\n<p>According to Article 16 of the ICC statute, by a<br \/>\nresolution under Chapter VII of the UN Charter, the Security Council<br \/>\nmay suspend the ICC&#8217;s investigation and its prosecution for 12 months<br \/>\nand may prolong the period.<\/p>\n<p>For example, the African Union (AU)<br \/>\nstrongly supports this movement against the ICC&#8217;s investigation and<br \/>\nsome other non-African countries may also come down in favor of this<br \/>\nmovement.<\/p>\n<p>Security Council Resolution which suspends the investigation and prosecution of President Bashir because of two reasons.<\/p>\n<p>First,<br \/>\ninternational justice should not be used as a tool for political<br \/>\nnegotiations in terms of universal value. Moreover, it is quite<br \/>\nimpossible to develop sustainable peace without addressing serious<br \/>\nhumanitarian issues and human rights abuses.<\/p>\n<p>Such an opinion<br \/>\nconcerning the ICC&#8217;s investigation is supported not only by HRN but<br \/>\nalso by many members of international society.<\/p>\n<p>For instance,<br \/>\nsome countries and major NGOs including Human Rights Watch and Amnesty<br \/>\nInternational have expressed their opinions against moves to suspend<br \/>\nthe ICC&#8217;s investigation and prosecution.<\/p>\n<p>Furthermore, G8 countries also support the ICC&#8217;s investigation in Sudan.<br \/>\nIn June of 2008, the Chair&#8217;s Summary of the G8 Kyoto Foreign Ministers&#8217;<br \/>\nMeeting before the G8 summit in Toyako said, &#8220;We urge the Government of<br \/>\nSudan and all other parties to completely cooperate with the<br \/>\nInternational Criminal Court in order to end the impunity of serious<br \/>\ncrimes committed in the Darfur region,&#8221; and demanded that each country<br \/>\ncooperate with the ICC&#8217;s investigation in Sudan.<\/p>\n<p>In particular, Japan should commit to and take leadership in this situation. Japan was the chair country of the G8 Foreign Ministers&#8217; Meeting held in Kyoto and released a statement supporting the ICC&#8217;s investigation in Sudan.<\/p>\n<p>In other words, Japan<br \/>\nhas a responsibility to be emphatically against any international<br \/>\nmovements towards suspending the ICC&#8217;s investigation and should call<br \/>\nfor the international justice.<\/p>\n<p>We would like to emphasize again that international justice is fundamentally not substitutable.<\/p>\n<p>If<br \/>\nwe let some countries stop the ICC&#8221;s investigation and prosecution<br \/>\nbecause of political bargains, the authority of the ICC will be lost<br \/>\nand the situation will cause serious troubles in future.<\/p>\n<p>Human<br \/>\nRights Now calls on international society and especially the Japanese<br \/>\ngovernment to protest against the suspension of the ICC&#8217;s investigation<br \/>\nin Sudan and the looks towards the fruition of sustainable peace based<br \/>\non international justice.<\/p>\n<p class=\"MsoNormal\" style=\"margin: 0mm 0mm 0pt; line-height: 200%;\"><span lang=\"EN-US\" style=\"font-size: 12pt; line-height: 200%; font-family: 'Times New Roman';\"><span style=\"font-size: 0.8em; color: #000000;\">\u00a0<\/span><\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>5 October 2008 Human Rights Now (HRN), an international human rights NGO based in Tokyo, has made the following statement concerning the current situation in the Republic of Sudan on 5 October 2008, in the interests of seeking peace by way of conquering human rights abuses in the country.
