No investigation, justice or accountability<br \/>\nregarding alleged violation of international human rights and<br \/>\ninternational humanitarian during the recent Israeli attack against the<br \/>\nGaza Strip, has been realized until recently, in spite of more than<br \/>\n1,400 alleged deaths. It has been nearly five months since the United<br \/>\nNations Human Rights Council adopted its resolution to dispatch this<br \/>\nfact-finding mission on 12th January and therefore the dispatch has<br \/>\nbeen awaited. The United Nations Headquarters set up the &#8220;Board of<br \/>\nInquiry&#8221; to investigate damages done to United Nations premises during<br \/>\nthe recent attack in the Gaza Strip. In April, the Board submitted a<br \/>\nreport concluding that six incidents out of nine in the United Nations<br \/>\npremises were intentional attacks by the Israel Defense Force. <br \/>This<br \/>\nfact-finding mission deals not only with incidents at the United<br \/>\nNations premises but also with all other violations of international<br \/>\nhuman rights and international humanitarian law during the conflict.<br \/>\nHuman Rights Now expects an fair and impartial investigation regarding<br \/>\nattacks against civilians and civilian premises as well as the use of<br \/>\ninhumane weapons, such as White Phosphorus, to be carried out<br \/>\nintensively.<br \/>2. Human Rights Now calls on both parties concerned to fully cooperate with the mission. The <st1:country-region w:st=\"on\">Israel<\/st1:country-region> government has made the mission especially difficult by refusing entry not only into the Gaza Strip but also into <st1:country-region w:st=\"on\"><st1:place w:st=\"on\">Israel<\/st1:place><\/st1:country-region>.<br \/>\nThis time, the mission entered the Gaza Strip through Rafah in<br \/>\ncooperation with the Egyptian government. So far there is no hope of<br \/>\nits investigation in the West Bank and <st1:country-region w:st=\"on\"><st1:place w:st=\"on\">Israel<\/st1:place><\/st1:country-region>. Thus, Human Rights Now strongly calls upon the <st1:country-region w:st=\"on\"><st1:place w:st=\"on\">Israel<\/st1:place><\/st1:country-region> government to cooperate with the mission. <br \/>3.<br \/>\nHuman Rights Now expects the mission to submit its report to the United<br \/>\nNations without delay. The United Nations must take appropriate steps<br \/>\nto follow up on recommendations of the mission. In this respect, the<br \/>\nactions which the United Nation Secretary-General took last month<br \/>\nregarding the recent conflict in the Gaza Strip were very<br \/>\ndisappointing. Secretary General Ban Ki-Moon, after the submission of a<br \/>\nreport by the Board of Inquiry in April, has not taken any actions to<br \/>\nfollow up on its eleven recommendations except a submission of a<br \/>\nsummary of the report to the Security Council. He did not even release<br \/>\nthe full report of the Board to the public. More significantly,<br \/>\nalthough the report calls upon the United Nations for further<br \/>\ninvestigations regarding international human rights and international<br \/>\nhumanitarian laws, the Secretary General clearly stated that no<br \/>\ninvestigation would be carried out by the United Nations in this<br \/>\nmatter. There is a strong possibility that intentional attacks to the<br \/>\nUnited Nations premises amount to war crimes under the Geneva<br \/>\nConventions. Civilian death caused by these attacks may also be due to<br \/>\nviolations of the Geneva Conventions. In a situation where grave<br \/>\nviolations of these international laws have been questioned, it is<br \/>\nunacceptable by any measure for the United Nations to turn against an<br \/>\ninvestigation of the truth and the pursuit of justice. In cases where<br \/>\nviolations of international human rights and international humanitarian<br \/>\nlaw are found by an impartial UN mission, the United Nations must act<br \/>\nto ensure justice and accountability.<br \/>Human Rights Now expects the<br \/>\ndispatch of the fact-finding mission, mandated by the United Nations<br \/>\nHuman Rights Council, to be the first step in realizing justice and<br \/>\naccountability in the Gaza Strip. Human Rights Now calls upon the<br \/>\ninternational community to take strong initiatives to ensure the<br \/>\naccountability for the deaths of more than 1,400 civilians, prosecute<br \/>\nand convict those responsible, and provide compensation for the<br \/>\nvictims. <br \/>In addition, Human Rights Now expects the dispatch of the<br \/>\nmission to lead to the further cessation of human rights violations<br \/>\nsuch as severe restriction of import of goods including reconstruction<br \/>\nresources to the Gaza Strip.<o:p><\/o:p><\/font><\/font><\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>4 June 2009 &nbsp; Press Statement International society should support UN Mission on Gaza as the first step for accountability on human rights violation in Gaza On June 1, 2009, a United Nations fact-finding mission, chaired by Richard Goldsmith, has started to investigate violation of international human rights and international humanitarian law related to the conflict in the Gaza Strip from December 27, 2008 through January 18, 2009. 1.
